INTRODUCTION
WrestleGods, currently located on the Internet at www.wrestlegods.com,
and in other locations, (collectively the Network) is an online store,
information, entertainment, and communication service, operated by
WrestleGods. By completing the registration process, you become an
authorized member of the Network (a WrestleGods Member) AND AGREE TO BE
BOUND BY THE TERMS, CONDITIONS AND POLICY AND PROCEDURES OF THIS
AGREEMENT. PLEASE READ THE AGREEMENT CAREFULLY BEFORE COMPLETING
THE REGISTRATION PROCESS.

SERVICES
As a WrestleGods Member, you will have access to various services which
enable you and other WrestleGods Members to interact with each other
(Member Area). These services include the following:
* WrestleGods Member Profiles
* WrestleGods Polls and Surveys
* WrestleGods Newsletters
* WrestleGods Events
* WrestleGods Store
* WrestleGods Chat Rooms (when available)
* WrestleGods Member discounts
* WrestleGods Reviews and Previews of Wrestling, Bodybuilding and more.
You will also have access to various
other content and content that may be added in the future, therefore, we
may change our service offerings or make other new services available to
you from time to time.
EMAIL AND SPAM
By completing the registration process, whether in the main profile area
of the WrestleGods website or in the Chat area of the WrestleGods area,
you agree to accept emails, including; new letters, promotions, surveys
and updates from WrestleGods. If you choose to "opt out"
from receiving such emails, you will automatically be deleted as a
member of WrestleGods and all is benefits and services.
WrestleGods.com observes a strict ANTI-SPAM policy. Your email
information was entered into our database DIRECTLY at www.wrestlegods.com
by you. WrestleGods.com sends an email out to you approximately
once a month to verify your email that is listed on your WrestleGods'
profile and Chat Room profile. In the event your email address has
changed or it returns to us as undeliverable, we will delete your
profile from all areas of the website. You agree to keep
WrestleGods informed of any profile changes by going to www.wrestlegods.com
and click on "edit profile".
FEES
WrestleGods provides a profile service for minimal fees . To become a
WrestleGods Member, you must pay the stated fees and complete our registration process (the
Profile Form) and agree
to the terms of this Agreement.
NETWORK RULES
Following are some basic rules that apply to the Network; failure to
comply with these rules can lead to cancellation of your membership and
forfeiture of any fees paid to WrestleGods by the Member.
Respect other WrestleGods Members.
You may not post or transmit on the Network any defamatory, inaccurate,
abusive, obscene, profane, vulgar, sexually explicit, threatening,
harassing, or illegal material, or any material containing blatant
expressions of bigotry, racism, or hate.
You may not engage in behavior that could
lead to unlawful contact with minors, whether on or off the Network.
You may not pretend to be anyone whom you
are not. You may not impersonate a WrestleGods employee or
volunteer, another member, or any other individuals.
We reserve the right at our sole
discretion (but are not obligated) to review and edit, delete, or refuse
to post any material submitted for display or placed on the Network,
including but not limited to message board posts, profile content,
photos, and images, and reviews.
You may not scroll, flood, spam, or
otherwise interfere with other Member's ability to use Member Areas or
the Network. You may not use your WrestleGods Member Email to send
spam to other Members or anywhere off the Network.
You may use the Network only for lawful
purposes. You may not post or transmit any material that violates
the rights of others, infringes a person's intellectual property rights
(such as copyrights, patents, or trademarks), or is otherwise unlawful
or encourages unlawful activity. Posting or transmission of any
material that violates any federal, state, or local law or regulation is
prohibited, and we reserve the right to notify law enforcement
authorities in such event.
You may not post any advertising or
solicitation regarding products or services on the Network, except where
maybe specifically permitted now or in the future.
You must respect the security of our
Network. You may not try to gain access to areas that are private
to WrestleGods or to other WrestleGods Members. You may not
attempt to interfere with the normal operation of the Network by
flooding or otherwise interfering with Network host machines.
PRIVACY
Our Privacy Policy states in full our policy regarding member privacy;
see that document for more details.
We will endeavor to maintain the privacy
of your private electronic mail ("email") messages, but make
no representation, warranties, or guarantees with respect to our ability
to do so. We will not inspect the content of your emails or
disclose their content except as permitted or required by law. We
do not permit any merchants, other than WrestleGods, to send email
messages to WrestleGods Members for commercial purposes. We do not
distribute WrestleGods Member's name and/or email addresses to any third
parties.
PUBLIC AREAS
A Public Area ("Public Area") of the Network is any area where
you may submit material ("Submissions") for viewing by others
or view Submissions of other WrestleGods Members, such as bulletin
boards, forums, chat rooms, or Members' Profiles. In some of
these areas a submission includes the name, ID, nickname, and/or other
information that would be displayed with the submitted material, as
applicable. You agree to use Public Areas in accordance with any
policies for the Public Areas that are displayed on the Network.
You may not submit copyrighted material to Public Areas if you do not
personally hold the copyright to such material, except to the extent
such submission: (i) would constitute a "Fair Use", as such
term is defined in Title 17 (Copyrights) of the United States Code,
Section 17; or (ii) is in the public domain.
BY SUBMITTING MATERIAL TO A PUBLIC AREA, YOU AGREE TO INDEMNIFY
WrestleGods AND HOLD IT HARMLESS FROM ALL CLAIMS, INCLUDING CLAIMS FOR
LIBEL, SLANDER, AND COPYRIGHT INFRINGEMENT, ARISING FROM THE SUBMISSION.
By making a Submission of your copyrighted material to any Public Area,
you automatically grant WrestleGods the royalty-free, perpetual,
irrevocable, nonexclusive right and license to use, reproduce, modify,
adapt, publish, translate, and distribute the content of the Submission
in any form, media, or technology now known or hereafter
developed. You also permit any WrestleGods Member or other user of
the Network to access, view, store, or reproduce the Submission for that
person's personal use.
LINKS
Our provision of a link to any other site or location is for your
convenience and does not signify our endorsement of such other site or
location or its contents. WrestleGods shall not be responsible for
any information, software, or links found at any other World Wide Web
site, Internet location, or source of information, or for your use of
such information.
INFORMATION PROVIDED/NO ADVICE
ANY DATA AND/OR INFORMATION PROVIDED TO YOU ON OR THROUGH THE NETWORK
("INFORMATION"), WHETHER DEVELOPED BY WrestleGods OR PROVIDED
BY THIRD PARTIES ("INFORMATION PROVIDERS"), IS NEITHER
GUARANTEED NOR WARRANTED, EXPRESSLY OR IMPLIEDLY, BY WrestleGods OR ITS
INFORMATION PROVIDERS FOR ITS ACCURACY, RELIABILITY, COMPLETENESS,
TIMELINESS, OR SUITABILITY FOR YOUR USES OR THOSE OF ANY OTHER PERSON,
OR IN ANY OTHER WAY. WrestleGods AND THE INFORMATION PROVIDERS
SHALL NOT HAVE ANY LIABILITY, CONTINGENT OR OTHERWISE, TO YOU FOR ANY OF
THE FOREGOING, OR FOR ANY ACTIONS TAKEN OR DECISIONS MADE BY YOU OR ANY
OTHER PERSON IN RELIANCE UPON SUCH INFORMATION.
YOU ACKNOWLEDGE THAT NEITHER THE NETWORK,
NOR ANY OF THE INFORMATION, IS INTENDED TO SUPPLY, NOR IS WrestleGods OR
ANY INFORMATION PROVIDER SUPPLYING LEGAL ADVICE, ADVICE REGARDING THE
SUITABILITY OR PROFITABILITY OF ANY PRODUCTS OR INVESTMENTS, ANY HEALTH
OR MEDICAL ADVICE, WRESTLING TECHNIQUES, WORKOUT TECHNIQUES, ANY OTHER
SPORT TECHNIQUES, OR ANY OTHER ADVICE OF A PERSONAL OR PRIVATE NATURE.
Although the Network may provide access
to Information and recommendations and research about the foregoing
topics, WrestleGods does not represent that such recommendations or
techniques are suitable to you or any other person. You shall make
your own independent evaluation of the suitability of such
recommendations or techniques. You assume full responsibility and
liability for any and all legal, investments, medical, health,
techniques, or other personal decisions you make.
NO WARRANTIES. EXCLUSION FROM
LIABILITY
Your use of the Network and any Information is at your own risk.
WrestleGods is not liable for the defamatory, offensive, or illegal
conduct of other WrestleGods Members or third parties.
NEITHER WrestleGods NOR ANY OF ITS
INFORMATION PROVIDERS, MAKES ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
OR NON-INFRINGEMENT, REGARDING THE NETWORK, THE INFORMATION, OR ANY
SERVICES OR MERCHANDISE PROVIDED OVER OR THROUGH THE NETWORK, OTHER THAN
THOSE WARRANTIES WHICH ARE INCAPABLE OF EXCLUSION UNDER THE LAWS
APPLICABLE TO THIS AGREEMENT
NEITHER WrestleGods, THE INFORMATION
PROVIDERS, NOR ANY OTHER PERSON INVOLVED IN CREATING OR DISTRIBUTING THE
NETWORK WILL BE LIABLE TO YOU FOR ANY LOSSES OR DIRECT, CONSEQUENTIAL,
SPECIAL, INCIDENTAL OR INDIRECT DAMAGES THAT MAY RESULT FROM YOUR USE OF
THE NETWORK, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR
LOSSES.
OWNERSHIP OF MATERIALS
The contents of the Network, including text, software, photos, and
graphics, are copyrighted by WrestleGods Individually and as a
collective work under the United States copyright laws. Except for
material in the public domain, WrestleGods and its licensors hold
copyrights to all content appearing on the Network. Neither
content nor software may be copied, modified, reproduced, republished,
posted, transmitted, sold, offered for sale, or redistributed in any way
without the sole permission of WrestleGods and its applicable licensors,
wit the sole exception that one copy may be downloaded onto a single
computer for your personal, non-commercial use.
INDEMNIFICATION
You agree to hold harmless WrestleGods and its Information Providers, as
well as each of their respective affiliates and their respective
directors, officers, employees and agents from and against all claims
and expenses, including attorneys' fees, arising out of the use of the
Network by you or your account.
CHOICE OF LAW
You agree that the laws of the State of Oklahoma and the United States will
apply to all matters relating to this Agreement, as they would to
agreements made and entered into entirely in Oklahoma by Oklahoma Residents.
MODIFICATION OF AGREEMENT
You agree that WrestleGods may change the terms and conditions of this
Agreement, unilaterally, and at any time, by conspicuously posting
notice of such change in an area of the Network for a period of five (5)
consecutive days. continued use of the Network after such notice
will constitute your acknowledgment and acceptance of the revised terms
and condition.
GENERAL
This Agreement is the entire understanding between you and us regarding
your relationship to the Network and WrestleGods. If we fail to
notify you of any violations of this Agreement, this will not mean that
we cannot notify you of future violations of this Agreement.
